General terms and conditions

1. Scope of application

The following general terms and conditions apply to services (tickets, guided tours and products) sold via the website of the HEK (Haus der Elektronischen Künste). If certain terms and conditions apply exclusively to certain types of service, this will be indicated separately below.

2. Contracting parties

The contractual partner of the user of these terms and conditions is hereinafter referred to as the “customer”. The user of these general terms and conditions and hence contractual partner of the customer when booking tickets, guided tours and products is the Foundation House for Electronic Arts Basel, St. Alban-Vorstadt 5, 4052 Basel – hereinafter referred to as “HEK”.

3. Exclusion clause

Any terms and conditions of the customer’s that deviate from or conflict with these terms and conditions are effective only if they have been expressly confirmed in writing by the HEK.

4. Conclusion of contract

The contractual relationship for the purchase of tickets, guided tours and products is exclusively between the HEK and the customer. The customer commissions the HEK with the processing of the contracts. Products are only sold directly to end customers. When selling in its own name and on its own account to other customers, the HEK reserves the right to withdraw from the contract for a period of 30 days after conclusion of the contract. When making an online ticket booking or purchase, the customer submits a contracting offer and accepts these general terms and conditions by clicking "Send Order" (or an equivalent button). The offer is accepted via e-mail notification to the customer. The booking or order is therefore binding. Cancellation is only possible in accordance with the conditions set out in point 7. No warranty can be assumed for the correctness of event dates on the website.

5. Prices and payment

5.1. Tickets and products

When purchasing online tickets and/or shop products, customer payment after conclusion of the contract shall be made via bank transfer, debit or credit card (Maestro, (Maestro-CH), MasterCard, Visa, V-Pay).

5.2. Guided tours

When purchasing guided tours online, payment by the customer is made after conclusion of the contract via bank transfer, debit or credit card (Maestro, (Maestro-CH), MasterCard, Visa, V-Pay). Admission is not included in the guided tour fee (max. 20 persons/guided tour). In the case of telephone bookings (only available for guided tours) via the HEK’s tour coordination team, the customer submits their contracting offer by providing their personal data for the booking. By sending booking confirmation via e-mail, the HEK accepts the offer. The booking is therefore binding. Cancellation is only possible in accordance with the conditions set out in point 7. The HEK accepts no responsibility for the accuracy of data provided by the customer by telephone. Group tours are carried out by a guide from the HEK after booking confirmation and payment of the invoice. The guide is selected by the tour coordinator. The specified registration deadlines and tour modalities apply.

6. Shipping and delivery

6.1. Tickets

Tickets are sent by e-mail as print@home tickets attached to the booking confirmation in a PDF format. The ticket entitles the holder to enter the exhibition on the stated date. The ticket loses its validity upon exiting the HEK. Only tickets themselves entitle the holder to admission. Booking confirmation alone does not count as a ticket. Each individual ticket can be printed out as often as desired; it is uniquely identified by a barcode, which enables one entry only. Upon entry, the ticket is checked by means of a scanner. Without a valid ticket, admission cannot be granted and a new ticket must be purchased at the museum ticket office. A refund of purchased tickets is not possible. Lost or stolen print@home tickets cannot be replaced. Please keep your ticket in a safe place. For discounted student tickets, a valid student ID is required and must be presented unrequested. Discounted tickets without valid identification are invalid and will be confiscated.

6.2. Guided tours

Tour confirmation will be sent by e-mail in a PDF document attached to the automatic confirmation. Please bring this confirmation document with you to the tour.

6.3. Publications and shop products

Orders from the HEK shop are delivered within 5 working days. Delivery is fulfilled subject to shipping costs shown for each order transaction. Art editions are individually processed, packed and shipped insured. Please contact us by email or by phone +41 061 283 60 50. Delivery times depend on the postal service in the countries of order. All communicated delivery times or delivery dates are non-binding. Should a new delivery be necessary due to incorrect address information or non-collection, the customer shall bear the additional shipping costs incurred. Any customs duties, processing fees and tax levied by the recipient country in conjunction with shipping abroad shall be borne by the recipient. For delivery in Switzerland, VAT is included in the price shown. For shipping to other countries, the price shown is net, i.e. without VAT.

7. Cancellations

7.1. Tickets

Cancellation of tickets is not possible.

7.2. 2 Guided tours

Group tours may be cancelled in writing by e-mail or letter to the HEK. No charge will be made for cancellations received by the tour coordination office,, up to 2 working days before the tour date. In this case, the payment attributable to the cancelled service will be refunded. In the event of cancellation less than 2 working days before the appointment or in the event of non-appearance, a fixed rate of CHF 200 will be charged. Receipt by the management coordination of the HEK is decisive for compliance with the deadline; the client must provide proof of this. Cancellation is only possible for the entire tour; if the number of participants is reduced, the agreed fee will apply. No liability is accepted for cancellation of the guided tour due to force majeure or the like. A postponement of the tour by the HEK of up to 30 minutes does not entitle the participant to a reduction of the fee.

7.3. Return of goods

Products may be returned within 10 days in their original packaging and without signs of use. Return shipping costs are borne by the customer. All items will be checked before dispatch and sent in perfect condition. The purchaser must inspect the goods upon receipt and notify HEK immediately of any defects. If this is not done, the goods are deemed to have been approved. Returns will be refused if the goods are damaged or show signs of use and/or incomplete packaging. Returns made after 10 days or later will not be refunded or returned. If items are damaged or lost during return shipping, a refund is not possible. Return shipping with tracking is recommended. Postal or customs charges which might arise will not be accepted. Accepted returns will be refunded by replacement delivery. Only goods with a receipt of purchase are accepted for return in the shop.

8. Data protection

The personal customer data shall be processed in compliance with the statutory data protection provisions applicable to the contract. The data is collected, processed and used in automated procedures to the extent necessary for the contractual relationship. The customer permits transmission of this data to third parties commissioned with the execution of the contract, insofar as this is necessary for fulfilment.

9. Final provisions

These terms shall be exclusively governed by and interpreted in accordance with Swiss law. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. Subsidiary agreements and amendments to the contract must be in writing in order to be effective. This formal requirement cannot be waived by oral agreements. Should any provision of this contract be wholly or partially invalid or subsequently lose its legal effect, the validity of the remaining provisions shall not be affected thereby. In place of the invalid provision, another appropriate provision shall apply by way of adjustment which economically comes closest to what the contracting parties intended or would have intended if they had observed the invalidity of the provision.

We reserve the right to amend and adapt these general terms and conditions as required; amendments only apply to contracts concluded after their publication.

The place of jurisdiction is Basel.
